פרקי אבות - מדריכים מעשיים? # 376

האם ההשקפה היהודית סוברת כי המצוות הן מדריכים מעשיים להתנהלות אנושית? לעתים קרובות מאוד נראה שהתשובה היא לא. למשל זה כתוב בתלמוד, "שכר מצוה בהאי עלמא ליכא" (קדושים לט). עמדה שכיחה בבית המדרש היא כמו רש"י שהביא את הספרא (ר' ויקרא כ כו), "אי אפשי ללבוש שעטנז. אי אפשי לאכול בשר חזיר. אי אפשי לבוא על הערוה" אבל "אפשי ומה אעשה ואבי שבשמים גזר עלי כך". נראה שהמשמעות היא שדברים אלה אינם מזיקים בעצם. זה נאמר בהקשר של קריאה לישראל להיות עם שמוקדש לאלוקים ונפרד משאר העמים. יש בו איום למסור אותם לידי נבוכדנאצר ואחרים כמוהו אם זה לא כך. כל זה נוטה להיות רחוק כדי להתמודד עם ההתבוננות בספר קהלת ח יד, "יֶשׁ־הֶבֶל אֲשֶׁר נַעֲשָׂה עַל־הָאָרֶץ אֲשֶׁר  יֵשׁ צַדִּיקִים אֲשֶׁר מַגִּיעַ אֲלֵהֶם כְּמַעֲשֵׂה הָרְשָׁעִים וְיֵשׁ רְשָׁעִים שֶׁמַּגִּיעַ אֲלֵהֶם כְּמַעֲשֵׂה הַצַּדִּיקִים אָמַרְתִּי שֶׁגַּם־זֶה הָבֶל". 

למעשה הטענה כי אין פרס על מצוות בעולם הפיזי הזה היא חלק מוויכוח ממושך המבוסס על המשנה האומר, "כל העושה מצוה אחת מטיבין לו ומאריכין לו ימיו ונוחל את הארץ וכל שאינו עושה מצוה אחת אין מטיבין לו ואין מאריכין לו ימיו ואינו נוחל את הארץ" (משנה קידושין א י). וגם אבות (ב א), "והוי מחשב הפסד מצוה כנגד שכרה, ושכר עבירה כנגד הפסדה". פירוש ברטנורא, "וֶהֱוֵי מְחַשֵּׁב הֶפְסֵד מִצְוָה. מַה שֶּׁאַתָּה מַפְסִיד מִסְּחוֹרָתְךָ וּמָמוֹנְךָ מִפְּנֵי עֵסֶק הַמִּצְוָה, כְּנֶגֶד הַשָּׂכָר שֶׁיַּעֲלֶה לְךָ מִמֶּנָּהּ בָּעוֹלָם הַזֶּה אוֹ בָּעוֹלָם הַבָּא".

למעשה המצוות מחולקות לעיתים קרובות למשפטים ולחוקים, מתורגמים לרוב בחופשיות כחוקים וחוקים. הדיכוטומיה היא שמשפטים נחשבים הגיוניים מהותיים כמו לא לשדוד או לרצוח. חוקים נחשבים לא הגיוניים מאוד ואף עלולים לגרום ללעג. דוגמאות לכך הן הגבלות על גילוח וטיהור מטומאה הנגרמת על ידי מגע עם מת. הסיבה העיקרית לכך שהם נשמרים היא משום שהם גזירות הקב"ה הכתובות בתורתו. אף על פי כן הרבנים אומרים כי לחוקים יש בדרך כלל היבט כלשהו של ההיגיון וכי משפטים עשויים להיות לא הגיוניים לחלוטין.

לשם כך המצוות יכול להיות הביט כמו עצות. למשל אם אדם רוצה לקיים יחסי אנוש טובים, התחלה טובה תהיה כיבוד הורים והימנעות מקנאה. אדם יהיה מאושר ונינוח יותר אם יעשה הפסקה מהעבודה מדי שבת כדי ליהנות מפרי עמלו להשקיע זמן בלימוד התורה הקדושה. המוח של האדם יהיה כנראה יותר בריא אם הוא בדרך כלל אמיתי.

הרעיון הוא שמצוות מועילות במהותן בגלל מטרתן המוצהרת. רעיון זה חזק יותר עבור אדם מיטיב, שאוהב להרהר בדברים, ומוכן לשנות דעות ופרקטיקות המוצגות כטעות. אולם אם אדם רדוד ויש לו נטייה חזקה לרוע, אז רעיון זה חלש בהרבה. במקרה כזה הגישה הטובה ביותר עשויה להיות ביצוע המצוות מכיוון שהן הגזרה של מלך היקום שמא יעניש אותך בזעם ובנקמתו.

Pirkei Avot - Practical Guides?

Does orthodox Jewish thought hold that the mitzvot are practical guides for human conduct? Very often it seems that the answer is no. For example it is written in the Talmud, “There is no reward for performance of a mitzvah in this world”, (see Gemara Kiddushin 39b). A common position in the beis midrash is like Rashi bringing the Sifra, “A man should not say I find it disgusting to wear garments of wool and linen, eat pork, or have relations with a married woman, but one should say, I would, indeed, like them, but what can I do since my Father in heaven has imposed these decrees upon me”. The implication seems to be that these things are basically harmless. This is said within the context of an exhortation for Israel to be a nation that is dedicated to G-d and is separate from the other nations. It also has a threat to turn them over Nebuchadnezzar and others like him if this is not so. All of this tends to be away to deal with the observation in the book of Ecclesiastes (8:14), “Exasperation exists in the world, like the righteous who get what the wicked deserve, and wicked that get what the righteous deserve; and even talking about this is exasperating".


In fact the claim that there is no reward for mitzvahs in this physical world is part of a lengthy debate based on the Mishnah which says, “Anyone who performs one mitzvah has goodness bestowed upon him, his life is lengthened, and he inherits the land, i.e., life in the World-to-Come. And anyone who does not perform one mitzva does not have goodness bestowed upon him, his life is not lengthened, and he does not inherit the land of the World-to-Come”, (Mishna Kiddushin 1:10). Also in Ethics of our Fathers (2:1) exhorts one to consider the loss caused by a mitzvah against its gain as well as the gain of a transgression against its loss. The Bartenura comments that this reckoning should apply to well-being in this world as well as the next. 


In fact the mitzvahs are often divided into mishpatim (מִשׁפָטִם) and chukim (חוּקִים), often loosely translated as statutes and laws. The dichotomy is that mishpatim are considered as intrinsically logical such as not to rob or murder. Chukim are considered not to be greatly logical and may even cause derision. Examples are restrictions on shaving and purification from ritual defilement caused by contact with a corpse. The main reason they are kept is because they are decrees of the Almighty written in His Torah. Nevertheless the rabbis say that chukim typically have some aspect of logic in them and that mishpatim may not be entirely logical. 


To this end the commandments can be looked upon as pieces of advice. For example if a person wants to have good human relations, a good start would be respecting parents and avoiding jealousy. A person will be happier and more relaxed if a break is taken from work every Saturday to enjoy the fruit of one's labor and tospend some time studying the sacred texts. A person’s mind will probably be more sound if he is generally truthful. 


The idea is that mitzvahs are intrinsically beneficial because of their stated purpose. This idea is stronger for a benevolent person, who likes to contemplate things, and is willing to change opinions and practices that are shown to be faulty. However if a person is shallow and has a strong inclination towards evil then this idea is much weaker. In that case the best approach may be to do the mitzvahs because they are the decree of the King of the Universe lest he punish you in His indignation and vengeance.

לזכור עשרה נסיונות של אברהם # 322

במשנה אבות (ה ד) כתוב, "עֲשָׂרָה נִסְיוֹנוֹת נִתְנַסָּה אַבְרָהָם אָבִינוּ עָה"ש". זה חלק מקבוצת אמרות שעוסקת במספר עשר. אחרי זה יש אמרות המקובצות סביב שבע ואז ארבע. החזרה על אותו מספר הופכת את החומר למהנה וקל לזכור אותו.
התנא רבי יהודה הנשיא לא מנה את המקרים שקרו לאברהם כאשר פירט מחדש את נוסח המשנה שנמצא בידינו כיום. הרמב"ם מונה את עשרת הניסויים באמצעות אירועים המפורשים בחומש לפי סדר התרחשותם. המפרש העיקרי למשנה, הברטנורה, מביא גם רשימה כסדר. עם זאת, ובניגוד לרמב"ם, הוא מתחיל במדרש בו אברהם נזרק לתנור הלוהט בילדותו באור כשדים, למרות שהוא לא נמצא בחומש. במקומו מונה הרמב"ם את הקשיים שאברהם נקלע כאשר התחתן עם הגר, שפחת שרה. כמו כן הרמב"ם שונה מונה את גירוש הגר וישמעאל לא כנסיון אחת אלא שתי נסיונות והוא משמיט את חזון הגולים.
הניסויים הרשומים על ידי הברטנורה זהים לאלה המנויים ב "אבות של רבי נתן", שחוברו מתוספתות בתקופת הגאונים. אבל זה מקובץ אחרת. זה מתחיל עם "לך לך", כלומר עזוב הכל ולך לארץ הקודש ואז אחר כך הרעב שגרם עזיבת א"י. בשלב הבא כתוב שני נסיונות הנוגעים לבניו של אברהם, המתייחסים לקרבן הקרוב של יצחק ולגירוש ישמעאל. להלן שני הניסויים בהם שרה התייחסה לחטיפות של פרעה ואבימלך. לבסוף מופיעים ארבעה: המלחמה של ארבעת המלכים נגד חמשת המלכים, חזון הסיוט של הטרגדיות המדהים את עם ישראל, נזרקים לתנור הלוהט באור כשדים והמילה.
זה יוצא עם רשימת הרמב"ם שיש שתי הרפתקאות הנוגעות להגר. לפיכך ניתן לצייר במרכז שלושה זוגות הכוללים את בני אברהם ושתי נשותיו. קל לזכור זאת. קל מאוד לזכור את לך לך והרעב מכיוון שהם מתרחשים ממש בתחילת פרשת לך לך ושניהם כרוכים בעזיבת מקומות חשובים. גם מבחן המילה קל לזכור. זה משאיר את מבחן מלחמת סדום. זה קצת קשה, אבל אם לוקחים בחשבון שזה בעצם קשור לאחיינו של אברהם לוט, הוא יבוא. בנוסף מגיע הרצף למחשבה. כמו כן התהליך מהנה ונותן לאדם משהו לחשוב עליו.
באופן אישי אני מחשיב את חזון הסיוט כמבחן מכיוון שאני יודע כמה חלומות והזיות חזקים יכולים להיות. גירוש ישמעאל והגר אני רואה כמבחן זהה לא שניים. אני לא רואה את הכבשן הלוהט כמבחן מכיוון שלפי הקריאה שלי במדרש, עבור אברהם כל העסק היה בדיחה פרועה. זה גם לא בחומש. כמה טוב אזכור את זה בעוד חצי שנה זו שאלה פתוחה. בכל מקרה זו הדרך ללמוד כמו שנאמר בקטע מענג בתלמוד, "סימנין עשה בתורה וקנה אותה", (שבת קד.).

Remembering the Ten Tests of Abraham

The Mishna in Ethics of our Fathers (5:4) states that the holy One, blessed be He, tested Avraham, our patriarch, ten times. It is part of a group of aphorisms involving the number ten. After that there are aphorisms grouped around seven then four. The repetition of the same number makes the material enjoyable and easier to remember.

Rabbi Judah the Prince  (c. 135 to 217 CE) did not enumerate the incidents that happened to Abraham when he redacted the standard Mishna that is in our hands today. Maimonides does enumerate the ten trials using events explicit in the Chumash in the order in which they occur. The prime commentary on the Mishnah, the Bartenura, also gives chronological listing. However, and unlike the Rambam, he starts with the Midrash about Abraham being thrown into the fiery furnace as a child in Or Casdim, even though it is not in the Chumash. In its place Maimonides lists the difficulties Abraham encountered when he married Sarah's servant Hagar. Also different the Rambam lists the expulsion of Hagar and Ishmael not as one but two trials and he omits the vision of the exiles.

The trials listed by the Bartenura are the same as those listed "Avot (Fathers) of Rabbi Nathan", which was compiled c. 700-900 CE from material contemporary to but omitted by Rabbi Yehuda HaNasi. It is grouped differently though. It starts with "Lech l'cha" (לך לך), meaning leave everything and go to the holy land and then the famine that forced Abraham to leave the land of Israel. Next it mentions two trials involving Abraham's sons, referring to the the near sacrifice of Yitzchak And the expulsion of Ishmael. Next are the two trials involving Sarah referring to seizures by Pharaoh and Avimelech. Finally four are listed: the war of the four Kings against the five kings, the nightmare vision of the tragedies strikingly the people of Israel, being thrown into the fiery furnace in Ur Casdim, and the circumcision.

It comes out with the listing of Maimonides there are two trials involving Hagar. Therefore one can picture three pairs in the center involving Abraham's sons and two wives. This is easy to remember. Lech lecha and the famine are also easy to remember because they occur right at the beginning of parshas Lech Lecha and both involve leaving important places. The test of circumcision is also easy to remember. That leaves the test of the war of Sedom. That one is a bit difficult, but if one considers that it was basically about Abraham's nephew Lot, it will come. In addition the chronology upon thought comes. Also the process is fun and gives a person something to think about. 

Personally I consider the nightmare vision as a test because I know how powerful dreams and hallucinations can be. The expulsion of Ishmael and Hagar I see as the same test not two. I don't consider the fiery furnace as a test because, according to my reading of the Midrash, for Abraham the whole thing was a rambunctious joke. It's also not in the Chumash. How well I'll remember this in six months is an open question. In any case this is the way to learn as it says in a delightful passage in the Talmud, "Make mnemonic signs [simanim aseh - סימנין עשה] to remember the Torah and acquire it", (Shabbos 104a).

Achre Mos / Kedoshim, Pirke Avot - The Responsibility of the Rabbis

Achre Mos opens with a tikun for the death of the sons of Aharon who died during the inauguration of the Mishkan in the desert because they offered a strange incense that was not requested (ויקחו בני אהרן נדב ואביהוא איש מחתתו ויתנו בהן אש וישימו עליה קטרת ויקרבו לפני ה’ אש זרה אשר לא צוה אתם), (Leviticus10:1). This is a difficult episode because people die by the hand of G-d for for what seems to be minor infractions if they are in fact infractions at all.


After that Moshe says "This is what the Hashem meant when He said, 'I will be sanctified through those near to Me”. Rashi explains that Nadav and Avihu were great men who were major leaders of Israel. If one analyzes the text of the Chumash one sees that the people leading Israel are Moshe, Aharon, and Miriam. Nadav and Avihu were in the second tier along with the sons Aharon, Eleazar and Ithamar, plus Joshua and Pinchas.

The intent of the pasuk is that the bringing of this incense was their own initiative and was a departure from a carefully prescribed pageant. Some see it as a spontaneous outpouring of religious enthusiasm, and explain that just like one should not become excessively intoxicated by wine likewise one should not excessively intoxicated by Torah. The Sifra on VaYikra (Chapter 10) emphasizes that Nadav and Avihu had their own reasoning and did not discuss their ideas with others. The gist of the commentaries is critical basically saying that this decision was not theirs to make and that they overstepped their authority. The pasuk can also be understood as them being very impetuous.

“Not requested” (לֹא צִוָּה אֹתָם) can be a tactful hyperbole for the word undesirable. In the Sifra the Holy One blessed be He is scripted as saying, “You brought before me a defiled (impure) fire”, (אתם הכנסתם לפני אש טמאה). In other words what Nadav and Avihu did was wrong both in form and substance. They were wrong to bring the incense they way they did and they were wrong to bring it period.

The difficulty still remains. Yes there was a glitch in the ceremony and say they did stink up the place. Still death by the hands of heaven seems to be an excessive penalty. The answer is that the errors of a leader can result in greatly damaging consequences for others. There is an aspect of this in Pirkei Avos 1:3 in the saying of Antignos the man of Socho to, “not be as slaves, who serve their master for the sake of reward. Rather, be as slaves who serve their master not for the sake of reward”.  Maimonides explains that the Sadducees distorted this statement by claiming that Judaism rejects the idea of reward and punishment for mitzvahs. It is in fact saying that a person should be doing the mitzvos because they are intrinsically good and that it is inappropriate to do them for a base motive.

The Sadducees were rejecting the Torah because they were clinging to base motives not because of difficulties with religious doctrines. They felt a need for a rationale to justify their decision and this maxim was easy to misuse. Later on Pirkei Avos (1:11) analyzes the need for scholars to weigh their words carefully. It fears that a lack of caution will result in misguided students, who will be destroyed in exile, because they have accepted bad ideas, and in the end there will be a desecration of G-d’s name.

The Torah is telling us that if a dirty smell takes root among the nation of Israel, the consequences can be a tragedy. Also impetuousness and presumptuous can be disastrous and should be uprooted. If the leaders of Israel strengthen them the consequences חו”ש can be disastrous. This shows the great responsibility that is assumed by the rabbis and educators of the Jewish people and how important it is to properly guide the nation in the ways of Torah.

שולחן המלך
שִׁבְעָה  אַל תְּבַקֵּשׁ גְּדֻלָּה לְעַצְמְךָ, וְאַל תַּחְמֹד כָּבוֹד, יוֹתֵר מִלִּמּוּדְךָ עֲשֵׂה, וְאַל תִּתְאַוֶּה לְשֻׁלְחָנָם שֶׁל מְלָכִים, שֶׁשֻּׁלְחָנְךָ גָדוֹל מִשֻּׁלְחָנָם, וְכִתְרְךָ גָדוֹל מִכִּתְרָם, וְנֶאֱמָן הוּא בַּעַל מְלַאכְתְּךָ שֶׁיְּשַׁלֵּם לְךָ שְׂכַר פְּעֻלָּתֶךָ.        

המשנה הנ"ל מתפרש לרוב כהכוונה נגד השאיפה ועידוד לאדם להיות שבע נחת ממה שיש לו. רבי עובדיה מברטנורא מפרש: אל תבקש גדולה - לרדוף אחר השררה. את המשך המשנה מפרש הרמב"ם: ואל תחמוד כבוד - להתכבד בתורתך, שמתוך כך אתה נראה כמי שעושה שלא לשמה. גם הרמב"ם מעיר: שֶׁשֻּׁלְחָנְךָ גָדוֹל מִשֻּׁלְחָנָם – הוא השכר שתקבל על למודך של תורה.


פרשנותו של מרדכי דב רבינוביץ על הרמב"ם מסביר את דברי הרמב"ם בדקדוק בלשון המשנה - באומרו, "וְאַל תַּחְמֹד כָּבוֹד, יוֹתֵר מִלִּמּוּדְךָ", מלמודך דייקא. הוא מעיר, "והכוונה: שאין כבוד יותר גדול מן הלימוד עצמו, ויאן ראוי לך שלא תחמוד כלל כבוד אחר יותר מהשגת הלימוד. פירושו דומה לפירוש הלחם משנה שמפרש: ואל תחמוד כבוד יותר מלמודך - פירוש יותר מהרגלך. לא תחמוד להוסיף עליו. שכל המוסיף גורע. ואמר המשל גמלא אזיל למבעי קרני. אודני דהוו ליה גזזי מניה. אבל הכבוד שאתה למוד ורגיל בו לא תניחהו. והחזק בו. שכך אמרו חכמים לעולם אל ישנה אדם מן הרבנות שלו.

אחד הלקחים של המשנה הוא שדברים כמו גדלות וכבוד אינם כשלעצמם מטרות ראויות. אעפ"כ הם עדיין רצויים במיוחד אם הם באים כתוצאת החוכמה של אדם. יותר מכך גורמת נזק ושמצה בלבד. עם זאת, כאשר הם עולים בקנה אחד עם הישגים ויכולות נכונים, אין לוותר עליהם.

לגבי השולחן בבית המקדש הערות הכלי יקר על הפסוק, "וצפית אתו זהב טהור ועשית לו זר זהב סביב", (שמות כה כד). פירושו: בכל מה שיזמין לו ה' לאכול משלחן גבוה ידמה בנפשו כאילו הוא מלך בעטרה שעטרה לו מדת ההסתפקות וכן ארז"ל (אבות ו.ה) ואל תתאוה לשלחנם של מלכים כי שלחנך גדול משלחנם וכתרך גדול מכתרם, עכ"ל. המשמעות היא כי הקב"ה נותן לו כל מה שהוא צריך.

זה כמו הרמב"ם במשנה תורה, "רשות כל אדם נתונה לו:  אם רצה להטות עצמו לדרך טובה ולהיות צדיק, הרשות בידו; ואם רצה להטות עצמו לדרך רעה ולהיות רשע, הרשות בידו. אל יעבור במחשבתך דבר זה שאומרים טיפשי האומות ורוב גולמי בני ישראל, שהקדוש ברוך הוא גוזר על האדם מתחילת ברייתו להיות צדיק או רשע.  אין הדבר כן, אלא כל אדם ואדם ראוי להיות צדיק כמשה רבנו או רשע כירובעם, או חכם או סכל, או רחמן או אכזרי, או כיליי או שוע; וכן שאר כל הדעות", (ספר יסודי התורה הלכות תשובה ה א ב).

היוצא מכל זה -  כי אדם צריך לדעת מה העבודה שלו ומה העבודה של האחר. כמו כן צריך להכיר את מקומו ואת המקום של אחרים. יחד עם זה מגיע הכרת חובות, רשעות, שמחה, הרגזות, של היחיד. שררה, רכוש, ויוקרה הם נוצצים, כתוצאה קל לטעות ולרדוף אחרי הדברים השייכים לאחרים ולהתעלם מן המתנות שאדם יכול להשיג עם המאמץ הראוי. המשנה זו באה לומר לנו כי הקובע הסופי הוא מה שאדם לומד ואיך הוא מעביר את הידע שלו לפעולה. אם יש לאדם תכונה זו הוא לא ירדוף אחרי גדלות וכבוד ולא מקנא מנת חלקם של עשירים ורבי עוצמה, אשר למעשה לא עושה להם טוב. אלא יראה את המתנות די והותר שהוא קיבל מן השמים ואיך מתאימים הם לו באמת.

אַל תְּבַקֵּשׁ גְּדֻלָּה לְעַצְמְךָ, וְאַל תַּחְמֹד כָּבוֹד, יוֹתֵר מִלִּמּוּדְךָ עֲשֵׂה, וְאַל תִּתְאַוֶּה לְשֻׁלְחָנָם שֶׁל מְלָכִים, שֶׁשֻּׁלְחָנְךָ גָדוֹל מִשֻּׁלְחָנָם, וְכִתְרְךָ גָדוֹל מִכִּתְרָם, וְנֶאֱמָן הוּא בַּעַל מְלַאכְתְּךָ שֶׁיְּשַׁלֵּם לְךָ שְׂכַר פְּעֻלָּתֶךָ.

Do not seek greatness for yourself, and do not desire status. More than your study, do. And do not desire the tables of kings since your table is greater than their table and your crown is greater than their crown. And your Employer is trustworthy to pay you the wages of your labor.

The above Mishna is generally understood as counseling against ambition and encouraging a person to be happy with what they have. The Bartenura understands not seeking greatness as not chasing after authority. Following Maimonides, he remarks concerning the phrase not to desire status as meaning not to become conceited about one’s knowledge of Torah because it creates the impression that it was not done with pure intent. Maimonides also comments on the phrase “your table is greater than their table” saying that this refers to the remuneration received for learning Torah.

The commentary by Mordechai Dov Rabinovitz on the Rambam explains this first by slightly varying the grammatical rendition of the mishna by saying you should not desire status in excess of your learning. He then remarks that the intent is that other prestige should not be greater than the prestige of the learning itself, and it is not fitting to desire additional prestige that is in excess of that which the knowledge has obtained. Similarly the Lechem Hashamayim understands the mishna as saying one should not desire status in excess of what was achieved in the learning. He explains this would mean more status than that which is typically received for a person’s level of scholarship. He continues that anything that is addition in fact detracts and brings an ancient parable that an ant who sought horns lost his ears. He concludes that the honor that normally comes from his knowledge, a person should not abandon and in fact should cling to it. He then quotes the sages that a man should never deviate from his normal rank.

One of the messages of the mishna is that things like greatness and prestige are not in and of themselves worthy objectives. Never the less they are still desirable especially if they come as a result of a person’s wisdom. Magnifying them only serves to damage and denigrate. However, to the extent that they are consistent with legitimate accomplishments and abilities, they should not be surrendered.

In regards to the table in the Holy Temple the Cli Yakar comments on the verse, “you will plate it with pure gold and make a gold rim around it.”, (Exodus 25:23). He explains that everything that Hashem prepares for him to eat comes from the table that is above and one should imagine in his soul that this is as if he is a king that has been crowned with the trait of sufficiency. The meaning is that G-d gives him everything he needs.

This is like Maimonides in his classic work the Mishna Torah:

“Free will is granted to all men. If one desires to turn himself to the path of good and be righteous, the choice is his. Should he desire to turn to the path of evil and be wicked, the choice is his . . . A person should not entertain the thesis held by the fools among the nations of the world and the many primitive among Israel that, at the time of a man's creation, The Holy One, blessed be He, decrees whether he will be righteous or wicked. This is untrue. Each person is fit to be righteous like Moses, our teacher, or wicked, like Jeroboam. Or he may be wise or foolish, merciful or cruel, miserly or generous, and likewise for all other character traits. There is no one who compels him, sentences him, or leads him towards either of these two paths. Rather, he, on his own initiative and decision, tends to the path he chooses,” (Laws of Repentance 5:1-2)

The point seems to be that a person needs to know what his work is and what the work of somebody else is. Likewise he needs to recognize his legitimate place and the place of others. With this comes recognition of individual duties, privileges, joys, and aggravations. Power, possessions, and status are flashy, as a result it is easy to err and chase after things that rightfully belong to others and ignore the gifts that a person can acquire with the proper amount of effort. This Mishna comes to tell us that the ultimate determinant is what a person learns and how he puts his knowledge into action. If a person has this trait they will not chase after greatness and status nor envy the lot of the rich and powerful, which in fact does them no good. Rather they will see the ample gifts they have received from heaven and how fitting they really are.

Ekev / Ethics of our Fathers 5:8-9 - A Just Society

ה:ח. שִׁבְעָה מִינֵי פֻרְעָנִיּוֹת בָּאִין לָעוֹלָם עַל שִׁבְעָה גוּפֵי עֲבֵרָה:
מִקְצָתָן מְעַשְּׂרִין וּמִקְצָתָן אֵינָן מְעַשְּׂרִין, רָעָב שֶׁל בַּצֹּרֶת בָּאָה, מִקְצָתָן רְעֵבִים וּמִקְצָתָן שְׂבֵעִים.
גָּמְרוּ שֶׁלֹּא לְעַשֵּׂר, רָעָב שֶׁל מְהוּמָה וְשֶׁל בַּצֹּרֶת בָּאָה.
וְשֶׁלֹּא לִטּוֹל אֶת הַחַלָּה, רָעָב שֶׁל כְּלָיָה בָּאָה.

גָּלוּת בָּאָה לָעוֹלָם עַל עוֹבְדֵי עֲבוֹדָה זָרָה, וְעַל גִלּוּי עֲרָיוֹת, וְעַל שְׁפִיכוּת דָּמִים, וְעַל הַשְׁמָטַת הָאָרֶץ.

5:8. Seven types of retribution come to the world, for seven types of sin. When some tithe and others don't, a hunger caused by turmoil ensues: some are hungry, others have their fill of food. When all are unanimous in their failure to tithe, a hunger by drought ensues. For not separating chalah, an annihilating hunger results.

Plagues come to the world for those capital crimes mentioned in the Torah that have not been given over to the court, and for desecrating the produce of the sabbatical year.

The sword comes to the world for the suppression of the law, the corruption of the law, and because of those who teach  the Torah in a way contrary to the accepted practice.

5:9. Carnage by wild beasts comes to the world for false oaths and the desecration of Gd's name.
Exile comes to the world for idol-worship, sexual promiscuity, murder and the failure to leave the land fallow on the sabbatical year.

The seventh and eighth Mishnas of the fifth chapter of Ethics of our Fathers describe various types of retributions that come from heaven as a result of various types of societal infractions. In Jewish thought not only are individuals judged based on their actions but the society as a whole is also judged and given a corresponding reward or punishment. Failure to financially support the poor and religious scholars results in various types of economic hard times. Corruption of the legal system results in plagues, violence, war, and wild animals. The three cardinal sins; idol worship, sexual obscenity, and murder; result in exile from the land of Israel. Failure to let the land lay fallow in the seventh year results in plagues and exile.

Two situations are described in regards to the failure to give tithes to the poor and students of Torah. In one case some people give them and some do not. The result is panic buying in which case some people have enough to eat, ostensibly those that were living up to their obligations, and some have little, ostensibly those that were not living up to their obligations. The second case is one where the tithes are ignored by society with the result being austerity caused by high prices. Wild beasts, plagues, violence, and exile likewise may be selective or general.

The discussion of corruption of the legal system provides details into the tricks and lies used to violate the Torah. The Mishna lists suppression of the law, distortion of the law, and misrepresenting the Torah so as to draw faulty conclusions. The Bartenura describes suppression of the law as knowing what the proper decision is but delaying or refusing to render it. Maimonides adds delaying by claiming further investigation is needed when in fact the matter is clear. The commentaries describe distortion of the law as vindicating criminals and convicting the innocent. Teaching Torah in a way not like the halacha, the commentaries describe as forbidding that which is permitted and permitting that which is forbidden. Commonly used methods include shallow sophistry, fragmentary quotes out of context, as well as generally ignoring the central messages of scripture.

The idea of corruption of justice brings the sword raises a number of issues among them societal corruption and indiscriminate killing. The Gemara hangs the ills of society on a corrupt legal system as it says, If you’ve seen a generation with many troubles, go and check the judges of Israel as all retributions that come, only come because of the judges of Israel .  . . and the holy One blessed be He does not shine His presence on Israel until have eliminated bad policemen and judges from Israel”, (Shabbos 139.). The situation though does not seem to be that of a good society with evil judges; rather it seems to be that of a society getting the judges they deserve.

The Gur Arye notes the phrase, “they cut a judgement” (see Sanhedrin 7:), and compares it to the cut of sword. Based on this he says that those that have the power to make a judgement have a sword in their hand. If the verdict is honest than the sword is with you, if it is corrupt a sword comes into the world. The idea is that G-d has entrusted the judges with his sword to rectify the ills of society. If the sword is not used properly He uses it Himself against all those He considers responsible.

Often to the eye of flesh and blood, war, plague, and starvation look like indiscriminate killing. This is because it may not be so obvious who put these crooked cops and judges in places of responsibility and is keeping them there. Also there is room for mercy with those that have made severe mistakes, but were honestly misguided. In addition the righteous also perish in tragedies. At times G-d will take a tsadik to shock the flock into realizing how evil their actions really are. Other times it is so HaKadosh Baruch Hu can don his robe made crimson by the blood of the righteous and torture the evil by saying this stain was caused by you. For the righteous they will sit by the right hand of Hashem for having made the supreme sacrifice.

It comes out that all Jews are responsible for each other and the institutions of our society are of our own making. When it comes to rooting out the evil in our midst, some people will have a genuine gun. Others may have a vote and others may only have an attitude. Never the less the tools that a person has may be very potent. The objective is to build a just, peaceful, and prosperous society in the land of Israel that will be a model for all mankind.

המשנה השביעית והשמינית של הפרק החמישי של פרקי אבות מתארים סוגים שונים של פורענות שמגיעים מן השמים כתוצאה מסוגים שונים של עבירות חברתיות. בהשקפה יהודית לא רק היחידים נשפטים בגלל מעשיהם אלא גם החברה כולה נשפטת ומקבלת שכר ועונש הראוי. אי תמיכה כלכלית בעניים ובתלמידי חכמים גורם  התוצאות החוקרות העניות ודתיות בסוגים שונים של כלכלה רעה. שחיתות של מערכת המשפט יכולה לגרום למחלה, אלימות, מלחמה, וחיות רעות. שלושת החטאים של ייהרג ואל יעבור; עבודת אלילים, גילוי עריות, ורצח; גורמים גלות מארץ ישראל. אי נתינה לאדמה לנוח בשנה שמיטה השביעית גורם למחלה וגלות.

שני מצבים מתוארים לגבי אי מתן מעשר לעניים ותלמידי התורה. במקרה אחד חלק מהאנשים נותן וחלק לא. במקרה אחד חלק מהאנשים נותן וחלק לא. התוצאה היא קנייה בהולה ובגלל זה כמה אנשים יש מספיק לאכול, לכאורה אלה שמרו את התחייבויותיהם, וכמה יש מעט, לכאורה אלה שלא שמרו את התחייבויותיהם. המקרה השני החליטו ע"י החברה שלא לעשר התוצאה צנע כלכלי הנגרם על ידי מחירים גבוהים. חיות פרא, מגפות, אלימות, וגלות גם עשויות להיות יחידיים או כלליים.

הדיון של שחיתות במערכת המשפט מגלה פרטים על הטריקים והשקרים שבהם נהגו להפר את התורה. המשנה מפרטת דיכוי החוק, עיוות של החוק, יצירת מצג שווא של התורה כדי להסיק מסקנות לקויות. פ' הברטנורא: ענוי הדין - שיודעים להיכן הדין נוטה ומעכבין ואין פוסקין אותו, עכ"ל. פ' הרמב"ם: עִנּוּי הַדִּין – הוא: אחור המשפט ועיון בו ימים רבין בדבר המבאר; מסביר עליו ע"י פ' מרדכי דב רבינוביץ: שהוא כבר מבורר למדי ואינו צריך עוד עיון ומשהים אותו כאילו הוא צריך עיון. הפרשנויות לתאר עיוות הדין שהצדיקו פושעים להרשעת חפים מפשע. לימוד תורה לא כמו ההלכה, הפירושים מתארים זה דומה לאיסור אשר מותר ומתיר אשר אסור. כמה שיטות כוזבות הם פלפול רדוד, ציטוטים מוצאים מהקשרם, גם כן התעלמות מההודעות המרכזיות של כתבי קודש. העניין של שחיתות של צדק מביא את החרב מעלה מספר נושאים ביניהם שחיתות חברתית הרג ללא אבחנה. הגמרא תולה את חוליי החברה על מערכת משפטית מושחתת כמו שכתוב, "אם ראית דור שצרות רבות באות עליו צא ובדוק בדייני ישראל שכל פורענות שבאה לעולם לא באה אלא בשביל דייני ישראל . . . ואין הקב"ה משרה שכינתו על ישראל עד שיכלו שופטים ושוטרים רעים מישראל", (שבת קלט.). אף המצב לא נראה שזה חברה טובה עם שופטים רעים; אלא כנראה זה חברה מקבלת השופטים שמגיע להם.

פ' גור אריה (דברים כ א ב): כי חרב בא לעולם על עיוות הדין (אבות פ"ה מ"ח), והכי נמי אם עשה דין יש לו חרב. כי הדין דומה לחרב המחתך, לכך אמרינן בכל מקום (ר' סנהדרין סוף ז ע"ב) 'חותכין את הדין'. לכך אם מעוות הדין, הרי חרב בא לעולם, ואם תיישר הדין, זה החרב הוא עמך, שהרי אתה חותך את הדין כהלכה. והיינו דאמרינן (שם) 'חרב בא לעולם על עינוי הדין, ועל עיוות הדין, ועל המורים בתורה שלא כהלכה', שכל אלו אינן מחתכין כראוי, לכך החרב בא עליהם.

עתים קרובות לאעין בשר ודם מלחמה, מגיפה, ורעב הם אנדרולומוסיא. הסיבה לכך שמסותר איזה הוא ששם שוטרים ושופטים עקומים במקומות של אחריות והוא משאיר אותם שם. כמו כן יש מקום לרחמים עם אלה שעשו טעויות חמורות, אבל היו באמת מוטעים. בנוסף הצדיקים גם גוועים בטרגדיות. לפעמים הקב"ה ייקח צדיק לזעזע את הצאן כדי להבין עד כמה רעים מעשיהם באמת. פעמים אחרות ייתן לקדוש ברוך הוא להתלבש בפורפירא שאדום מדמן של צדיקים ויענו הרשעים באומרו הכתם הזה נגרם על ידך. לגבי הצדיקים הם יישבו ע"י יד ימין של הקב"ה על מה שעשו את הקרבה עילאית.

המסקנה היא כל ישראל ערבים זה בזה. גם המוסדות של החברה שלנו הם מעשה ידינו. לעקור את הרע מקרבנו, יש אנשים עם אקדח ממש. לאחרים אולי יש הצבעה או רק מחשבה. אעפ"כ כלים כאלו אפשר שהם חזק ביותר. המטרה היא לבנות חברה צודקת, שלווה ומשגשגת בארץ ישראל שתהיה דוגמה לכל בני אדם.

VaEschanan / Ethics of our Fathers 4:19 - Downfall of an Enemy


שְׁמוּאֵל הַקָּטָן אוֹמֵר, "בִּנְפֹל אוֹיִבְךָ אַל תִּשְׂמָח וּבִכָּשְׁלוֹ אַל יָגֵל לִבֶּךָ, פֶּן יִרְאֶה ה' וְרַע בְּעֵינָיו וְהֵשִׁיב מֵעָלָיו אַפּוֹ",
(משלי כד יז יח).

Samuel the Small would say: "When your enemy falls, do not rejoice; when he stumbles, let your heart not be gladdened. Lest Gd will see, and it will be displeasing in His eyes, and He will turn His wrath from him [to you]" (Proverbs 24:17-18).

Dealing with the destruction of the wicked is a delicate contradictory subject. On one hand it is normal for a person to be happy with the fall of the wicked especially if he has been a victim of their persecution. On the other hand a decent person will also feel bad about death and ruin falling on any human being.

In the American war against slavery General Sherman brought its proponents to their knees by means of massive destruction. After an important victory, his soldiers held a large celebration. When General Sherman did not show up, they asked him why. He explained that he could not celebrate any victory that came over a mountain of dead bodies.

In a similar vein at the Pesach Seder the Jews celebrate the destruction of the Egyptians drowned in the Red Sea. Never the less a drop of wine is spilled from the cup of joy for each plague. This is because our joy is diminished because it came in connection with harm inflicted on others. This dichotomy is also captured in the laws concerning executions. It is required to publicly hang the corpse of the violator on a pole. However it must be buried before nightfall because the curse of G-d is on it and having it remain will defile the land.

Shmuel the Small, who wrote the above Mishna, was renowned as a great tsadik. One day when the sages of the Talmud were dining a voice from heaven declared concerning him that it was fitting that the divine presence should rest on him, except this generation did not merit such a thing (Sanhedrin 11.) In connection with this Rabban Gamliel the head of the Sanhedrin entrusted him with the difficult task of writing a prayer concerning the hardship caused by apostates, informers, and enemies of the Jewish people. He wrote that they should have no hope, be destroyed in an instant, and speedily and in our days be uprooted, shattered, pounded, embarrassed, brought low, and subdued; and blessed the G-d that does this. The prayer is included in the standard religious service today.

The quote above from Proverbs is mentioned in his name because he frequently said it. It stands in contrast, though, to many verses that seem to say the opposite. A frequently cited one is, “In the good of the righteous, the city rejoices, and when the wicked are lost, there is song”, (Proverbs 11:10). The commentaries are often distressed by this sentiment as it does not seem to be in the spirit of religion and make many attempts to reconcile it with the spirit of Shmuel HaKatan.

Rabbi Simcha the author of the Machzor Vitry comments that this refers to people who are happy about the misfortunes of their friends. He continues that this is only talking about people who hate each other because of worldly affairs. Shmuel, he continues, was discussing two religious scholars that wrestle with each other over the meaning of the law. In this situation one should not be jolly over his friend’s loss of the argument.

Rabbeinu Yonah of Gerondi comments that one should be careful concerning the demise of an evil associate because the happiness about the downfall may not be for the sake of heaven. The problem is that the person may not be hated because he is bad rather because he is an enemy.

Mordechai Rabinovitz in his elucidation of Maimonides commentary on the Mishna remarks that one should be forgiving and not harbor hatred in his heart and abstain from joy due to the catastrophes of associates even if they are reckoned as an enemy. However with the downfall of Haman and others like him it is suitable to celebrate as it says, “When the malevolent are lost there is song”.

In a conflict sometimes the winning side is good but has made mistakes. And sometimes the losing side is bad but never the less had a reasonable grievance. Therefore it is appropriate to celebrate victory in war with parades, fireworks, and speeches describing heroism in battle. However the celebration should not be ugly with things like gore or gratuitous humiliation of the loser. Neither should there be gloating, frivolity, or smug self-righteousness. The objective of the victor is to justify heaven’s confidence in him and not to do anything that will restore the power of the enemy.
