בהר - אַ גאַנץ יאָר שבת # 263

המצוות לגבי השנה השביעית ניתנות בפרשת בהר. זה לשון הכתוב "שבתה הארץ" כי הקרקע בשנה זו היא עזובה ולא עבודה. 'שבת' הכוונה לקחת הפסקה. בעיקרון ניצול מסחרי של הקרקע אסורה. זה כולל שתילה, חריש, וגיזום עצים. אנשים מעודדים לקחת מה שגדל לבדו לשימוש מיידי, אבל קציר מקצועי אסור. אפשר רק לטפל בדברים שאם יתעכב יגרם נזק חמור. החוקים הנוגעים לקניין הפרטי מושעים, בעיקר נגד כניסה בלתי חוקית, וכל מה שגדל הוא כמו פירות הבר במקום הפקר. הבעלים והעובדים, עשירים ועניים, חיות בית וחיות בר כולם חופשיים להשתתף בו. המקור העיקרי של המזון הוא מה שגדל בשנה השישית או קודם לכן.
השנה השביעית נקראת גם שמיטה שמשמעותה שחרור מחובות כספיות. כוונת המצווה היא לא לבטל את האשראי שניתן במהלך העסקים הרגיל או הלוואות עבור מכשירים יקרים, מכוניות, או בתים. זה סוג של פשיטת רגל עבור אלה ללא המשאבים לשלם במיוחד לעניים. גם סכסוכים כספיים יבוטלו. אבל אם אחרי כך יהיה לחיוב מספיק כסף לשלם, נקרא חסיד אם הוא משלם אע"פ שאין חיוב.
עבדים יהודים, משוחררים בשנת השמיטה. הם לא כמו עבדים "כנעניים" עיקרן הוא - חיים בפיקוח עם חוזה עבודה ארוך טווח. חלק מהעבדים היהודים הם חסרי כול. האנשים שעושים את זה בדרך כלל הם גנבים ופושטי רגל העושים זאת כדי לשלם חובות. שחרור העבדים האלה הוא סוג של מחילת חובות.
היובל בא אחרי השמיטה השביעית בשנת החמישים. זה נחשב שבת של שבתות. כל החוקים הנוגעים לשביעית חלים. בנוסף שדות ובתים בערים לחזור לבעלים אבותיהם. גם אלה צריך להיות מושכר ולא נמכר לצמיתות.
החומש עונה על השאלה הצפויה. לגבי השנה השביעית, אתה יכול לשאול, מה נאכל? לא נטענו ולא אספנו יבולים. אני אכוון לכם את ברכתי בשנה השישית, והארץ תביא די תוצרת לשלוש שנים. כאשר אתה זורע את השנה השמינית, אתה תאכול את היבול הישן שלך עד מתבשל היבולים של השנה התשיעית, (ראה ויקרא כה כ כד). פרשנויות יש הבנות שונות של זה. יש אומרים כי זה מתייחס לשנה השביעית לבד ומסיבות שונות היובל לא צריך להיות מיד אחרי שנה שבע. אחרים אומרים שזה מתייחס לשתי שנים רצופות שבהן הקרקע נותרה פראית.
במצוות אלה יש היבט של אחריותו של העם היהודי לטפל כראוי באדמת ארץ ישראל. הסיבה לכך היא כי הקרקע שמעובדת תמידי הופך מותש אלא אם כן הוא נח מעת לעת.

רש"י כאן משווה את מצוות מנוחה על השנה השביעית למצוה של מנוחה ביום השביעי. כמה גרסאות של רש"י (chabad .org) מוסיפים את שפתי חכמים ואת תורת כהנים (ז כה) כי זה לא למען הארץ, בכדי שהוא צריך להרוויח פוריות על ידי מנוחה בשנה. אלא כמו כל יום השביעי הוא יום שבת קודש כדי לשבח כי הקב"ה עצמו נח ביום השביעי. בכך לשבח כי הקב"ה הוא הבורא העליון של כל הקיום, כמו כן, האדם צריך לנוח מעבודת האדמה בשנה השביעית, לשם ה'.
אחרים אומרים כי המצוות כולל שבת הם גם לטובת האדם. במילים אחרות, כמו טוב לגבר לנוח יום אחד בשבוע וליהנות מהדברים שיש לו, כן טוב לדלג שנה אחד מתוך שבעה מן התוכנית הרגילה שלו. בנוסף, כמו שיש חגים השנה, כאשר זו מצווה לנוח, כך פעם אחת בחיים, טוב להמריא שנתיים ברציפות.
אדם שעובד שנה אחר שנה, קצת אחר מעט, נשרף, לפעמים בלי לדעת את זה. אולי הוא צריך שנה כדי לחשוב על המצב ואפילו להתכונן לשינוי מקצוע. גם זה יכול להיות הזמן לעשות סיור אמיתי, ללמוד חוכמה חדשה, או לעשות עבודה התנדבותית. עם שנתיים חינם אדם יכול לכתוב ספר.
עם קצת שקט ושלווה ניתן לראות כי העולם לה', כי האיש הוא רק עובר. השטח לא יושמד אם הוא פתוח לציבור שנה אחת וחיות בר אולי יהיו קצת ידידותים. גם אדם יכול לראות שהוא לא מקבל שום דבר על ידי שקר, רמאות, וגניבה, חוץ מן הרצון הרע של  אדם.
זוהי מצווה מפורשת בחומש. מעט מאוד אנשים שיכול לבא לזה בעצמם. מי מאמין שאפשר לדלג שנה מעבודה. לכן התורה בוודאי מן השמים הריבונו של עולם בוודאי חכם, נדיב, ולמעלה מן הטבע.

Behar - Sabbatical

The mitzvahs concerning the seventh year (שביעית) are given in parshas Behar. It is called a “Shabbos for the land” because the land in this year is to be left fallow and not worked. Shabbos basically means to take a break. Essentially commercial exploitation of the land is banned. This includes planting, plowing, and pruning trees. People are encouraged to pick that which grows by itself for immediate use, but professional harvesting is forbidden. One can only tend to things which if delayed would result in serious damage. Laws concerning private property are largely suspended particularly those against trespassing and anything that grows is treated like wild fruit in an ownerless area. Owners and workers, rich and poor, domestic animals and wild animals are free to partake of it. The main source of food is that which was grown in the sixth year or before.

The seventh year is also called shmita (שמטה) which means release because outstanding debts are forgiven. The intent of the mitzvah is not to annul credit extended in the course of ordinary business or loans for expensive appliances, cars, or houses. It is rather a form of bankruptcy for those without the resources to pay especially the poor. Financial disputes would also be annulled. Even so if the debtor should at some point be able to pay, they would be considered a gentleman for doing so.

Jewish slaves are also freed during shmita. They differ materially from “Canaanite” slaves in that it is fundamentally supervised living with a long term employment contract. Some of the Jewish slaves are the destitute. The main people doing it are thieves and bankrupts in order to pay off debts. The freeing of these slaves is a variation of the forgiveness of debts.

Jubilee falls after the seventh shmita in the fiftieth year. It is considered a Sabbath of Sabbaths. All of the laws concerning shevi’it apply. In addition fields and houses in cities revert to their ancestral owners. These should only be leased and not permanently sold.

The Chumash than answers an expected question. Concerning the seventh year, you might ask, What will we eat? We have not planted nor have we harvested crops. I will direct My blessing to you in the sixth year, and [the land] will produce enough crops for three years. When you plant the eighth year, you will be eating your old crops until the crops of the ninth year are ripe, (see Leviticus 25:20-24). The commentaries have differing understandings of this. Some say that it refers to the seventh year alone and for various reasons the Jubilee need not immediately follow a seventh year. Others say it refers to two consecutive years where the land was left fallow.

In these mitzvahs there is an aspect of the responsibility of the Jewish people to properly take care of the soil of the land of Israel. This is because land that is constantly cultivated becomes worn out of unless it lays fallow from time to time. Rashi here compares the mitzvah of resting on the seventh year to the mitzvah of resting on the seventh day. Some versions of Rashi (Chabad.org) add the Sifthei Chachamim and Torath Kohanim 25:7 that it is  not for the sake of the land so that it should gain fertility by lying fallow for a year. Just as every seventh day is a holy Sabbath day, acclaiming that G-d Himself rested on the seventh day and thus acclaiming that G-d is the Supreme Creator of all existence, likewise, man must rest from working the land on the seventh year, for the sake of G-d.

Others take the position that mitzvahs including Shabbos are also for the benefit of man. In other words just like it is good for a man to spend one day a week taking it easy and enjoying the things he has, so to it is good for him to take off one year out of seven from his regular routine. In addition just as there are holidays during the year, when it's a mitzvah to rest, so to once in a lifetime, it's good to take off two years in a row.

A person working year in and year out little by little gets burnt out, sometimes without knowing it. Maybe he needs a year to contemplate the situation and even prepare for a change in career. Also this could be the time to do some real touring, learn a new discipline, or do volunteer work. With two years free a person could write a book.

With some peace and quiet one can see that the world belongs to Hashem and that man is only passing through. The property will not be destroyed if it's open to the public for a year and the wild animals may actually turn out to be a bit friendly. Also a person may see that he doesn't gain anything by lying, cheating, and stealing, except the ill will of G-d and man.

This is a mitzvah that is explicit in the Chumash. Very few people though would come up with it on their own. Who would believe that you could actually afford to take a year off. Therefore the Torah must be from heaven and the Ribono shel olam must be wise, benevolent, and above nature.

Emor - Penny Wise Pound Foolish

Parshas Emor lists the religious holidays with a brief description of them. It begins with Shabbos then proceeds sequentially through the year starting with Passover. Next it elaborates on the mitzvah of the “omer”. An omer is a dry measure of approximately two quarts. In this case it refers to the new season’s first harvest of grain. The date for it to be gathered is the second day of Pesach which is in the early spring. It is then brought in its raw form as a sacrifice in the Temple with great ceremony. To honor it the new crop can only be eaten after the offering has been made.

Starting with the date on which the omer was brought 49 days together with the seven weeks time are explicitly counted. The fiftieth day is Shavuot and on it a second grain offering from the new crop is brought to the Temple. This time it is in the form of two loaves of bread.

Almost as an aside a mitzvah is given not to reap the corners of the field nor to pick up small quantities of produce that have fallen to the ground or have been inadvertently left in the field. Rather these are to be abandoned to the poor and the itinerant (see Leviticus 23:22). It is as if this is part of the process of advancing from unrefined barley that is really only fit for animals to fine bread that is welcomed at the banquet of the king.

In fact personal advancement is a theme of the counting of the omer. This is also a theme in the song “Bar Yochai Nimshachta Ashrecha”, sung in honor of the great Talmudic sage Rabbi Shimon bar Yochai. One stanza praises him for being in the inner sanctuary, drawing a green line, and revealing wonderful insights. It continues seven weeks are the secret of fifty. The seven weeks refer to the 49 days of the omer and the fiftieth which is Shavuot. The green line refers to the temporary lines a carpenter makes on the beams when constructing a building. In Kabbalah fifty is often a symbol for the fifty gates of understanding. Also the seven sefirot (kindness, strength, beauty, victory, glory, foundation, kingdom) are repeated seven times in a prayer said during the 49 day count of the omer.

The insight concerning ignoring the corners of the field, gleanings, and small forgotten articles, is not to be excessively meticulous about money and in doing so to be charitable. The Torah is telling the Jews not to squeeze every penny until the eagle screams. Don’t knock yourself harvesting every small corner of your field and by chasing after every small thing that falls or is forgotten. Let it go to whoever finds it and hopefully it will go to the poor. A similar situation is a bakery or manufacturer who donates second quality items to yeshivas. Likewise employees should not worked to the bone and given coolie wages. It's enough that they put in a proper day's work. In addition one should not be obsessed by one hundred percent utilization of equipment and space.

Developing good character can be difficult especially acquiring the proper outlook towards money. The hint of the omer is that it is a sketchy process. However in the end it transforms a bunch of slaves into a kingdom of cohanim.

אמור - אגורה חכם דוֹלָר טיפשי # 262


פרשת אמור מפרטת את החגים היהודים עם תיאור קצר עליהם. זה מתחיל עם שבת ואז ממשיך ברצף במהלך השנה החל מפסח. לאחר מכן הוא מפרט על מצוות העומר. עומר הוא מדד יבש של כשני ליטר. במקרה זה הוא מתייחס הקציר הראשון של העונה הראשונה של תבואה. התאריך שבו ייאסף הוא היום השני של פסח אשר בתחילת האביב. לאחר מכן הוא הביא בצורתו הגולמית כקרבן בבית המקדש בטקס גדול. כדי לכבד את זה היבול החדש ניתן רק לאכול לאחר הקרבתו.
החל מהמועד שבו הובא העומר 49 ימים יחד עם שבעת השבועות נספרות במפורש. היום החמישים הוא חג השבועות ועליה מובאת מנחת תבואה שנייה מן היבול החדש לבית המקדש. הפעם זה בצורה של שתי כיכרות לחם.
כמו דרך אגב מצווה לא לקצור את פינות השדה ולא לאסוף כמויות קטנות של תוצרת שנפלו על הקרקע או הושארו בטעות בשדה. אלה חייב לעזוב אותם לעניים ונודדים (ראה ויקרא כג כב). זה כאילו שזה חלק מקידום שעורה לא מזוקק, שהוא באמת רק מתאים לבעלי חיים, כדי לחם משובח בברכה במשתה של המלך.
למעשה, התקדמות אישית היא נושא לספירת העומר. זהו גם נושא בשיר "בר יוחאי נמשחת אשריך". בית אחד משבח את רבי שמעון על היותו בבית המקדש הפנימי, ציור קו ירוק, וחשיפת תובנות מופלאות. זה נמשך שבעה שבועות הם סוד חמישים. שבעת השבועות מתייחסים ל -49 ימי העומר והחמישים שבהם חג השבועות. הקו הירוק מתייחס לקווים הזמניים של נגר על הקורות בעת בניית מבנה. בקבלה חמישים הוא לעתים קרובות סמל לחמישים שערי ההבנה. גם שבע ספירות (חסד, כוח, יופי, ניצחון, כבוד, בסיס, ממשלה) חוזרים שבע פעמים בתפילה במהלך ספירת 49 יום של הספירה.
החידוש לגבי שלא לשים לב לזוויות השדה, הלקוחים והדברים הקטנים הנשכחים, הוא לא כדאי הקפידה יתרה בעניני כסף ועל ידי האי הקפידה לעשות צדקה. התורה אומרת ליהודים לא לסחוט כל פרוטה עד שהנשר צועק. לא לדפוק את עצמך על ידי קצירת כל פינה קטנה בשדה ועל ידי רדיפת אחרי כל דבר קטן שנופל או נשכח. תן לזה ללכת למי שימצא את זה בתקווה שזה ילך לעניים. מצב דומה הוא למאפייה או יצרן אשר תורם פריטים שהם סוג ב' לישיבות. כמו כן, אין להעביד עובדים עבודת פרך עם המשכורת שכמעט לא כדאית. מספיק שהם עושים עבודה של יום ראוי. בנוסף אין לשאף אחר שימוש של 100 אחוז של ציוד ומרחב.
פיתוח מדות טובות עיתים קרובות קשה במיוחד השגת השקפה נכונה כלפי כסף. הרמז של העומר הוא שזה תהליך סקוטי (סקעטטשי פּראָצעס). עם זאת בסופו של דבר זה הופך חבורה של עבדים להיות ממלכת כוהנים.

Achray Mos - Died for Your Sins

In parshas Acharei Mos HaKadosh Baruch Hu talks to Moshe rabenu after the death the two sons of his brother Aharon. The tone is one of consolation but the words are cryptic. It mentions that Nadav and Avihu died while bringing sacrifices but omits any suggestion of impropriety. First Aharon should be cautioned that there are dangers in entering the inner sanctuary of Hashem and it should not be treated like an ordinary occurrence. On the contrary his thoughts, dress, and cleanliness when doing so are significant. Next instructions are given on how to make ritual atonement for himself, his family, and the nation of Israel.

The object is to cleanse the inner sanctuary and the Temple as a whole from the defilement caused by the children of Israel. This defilement was caused by their sins, some of which were done maliciously. The Temple is described as being in an environment that is always filthy.

A major part of the purification rite is ritual of the scapegoat. In it the high priest, Aharon in this case, puts all of the sins of the entire nation on the head of this goat. After that the goat is sent into the jungle and to the devil who is to be found there. All of this plus fasting is to be done annually as part of the Yom Kippur holiday.

It is possible to view the scapegoat in two contradictory ways. It can symbolize a person,practice, or idea that is sinful and causes Israel to sin as did Yeravan ben Nevat. So to speak this goat caused Israel to sin and now it is being sent to hell. Alternatively it can be like the suffering servant in Isaiah chapter 43 who is harmed and humiliated by every stupidity and malicious act committed by the Jewish people. In that case the symbolism is that the sins of the children of Israel put a righteous person through hell and killed him. It can also be something in between.

From the standpoint of the narrative Aharon's sons are the scapegoat. It would seem that they were flawed tsadikim but also corrupted by society. The idea of the dangers of entering into the inner sanctuary of Hashem is that there are truths that can destroy. As such preparation especially in recognizing personal, family, and national frailties is essential. For example a person can be very learned and righteous but with a very thin heinous streak in their personality that is not only overlooked by others, but encouraged too. When it is viewed with omniscient knowledge with all of its horror and ugliness, the results can be shocking, especially if they constantly surround the Temple of Hashem and corrupt that which is most holy. In the final analysis HaKadosh Baruch Hu is merciful, long suffering, and cleanses sins one after another.

Tazria / Metsorah - Weirdo

The double parsha Tazria / Metsorah deals with what is colloquially called the disease of leprosy. One who is struck with it gets a sore which can take the form of a swelling, scab, or inflammation, where the hair on it has turned white. The mark can also show up on a garment or a building. In all cases a person must undergo a period of quarantine and ostricision until the sore goes into remission after which he is required to launder his clothes.

If the sore initially has a deep appearance or spreads while under observation then the one afflicted must additionally undergo an unusual elaborate purification ritual. He is required to provide two live kosher birds. One is slaughtered so that its blood flows into a pot of water into which the second bird along with a few other items is dunked. The bloody water is then sprinkled on the leper. A week later he must shave all of the hair including his head off the body, bathe, and launder his clothes. The final step is to bring a guilt offering and a sin offering with about a cup and a half of oil. Some of the blood of the sin offering is placed on the repentant leper’s ear, thumb, and big toe. The oil is applied in a similar fashion and a portion of it is poured on his head. If leprosy strikes a garment it is burnt in whole or in part. A building is basically demolished.

This is not a disease in the conventional sense because it is not debilitating nor does it cause pain. Something is clearly wrong even though the Chumash does not explicitly say so. The commentaries see a hint in the name of the malady in lashon hakodesh which is מְצֹרָע (metsorah). They say is a variant מוֹצִיא רָע which means to bring out evil. In other words the leper has done something bad and it is showing up through this sore. The Gemara (Tractate Arakhim 16a) lists the following seven reasons: slander, the shedding of blood, vain oath, obscenity, arrogance, robbery, and miserliness. These tend to be transgressions that are done secretly. Also a person can do these things and even get away with it although others do know about it.

The Torah is teaching that the bad that a person does can come out. There may be something strange about their home, clothes, body, behavior, something else. Sometimes the reason is obvious. Other times it can be figured out or guessed. Sometimes you don't know why, except something is wrong. It can be that the best approach is to distance yourself from the situation and hope that the rabbi can find a solution in his own way.

תזריע \ מצורע # 260 - תִמהוֹנִי

פרשת "תזריע-מצורע" עוסקת במחלת הצרעת. אחד אשר נפגע בזה מקבל פצע שהוא בצורה של נפיחות, צלקת או דלקת, ואת השיער שבו הפך ללבן. הסימן הוא לפעמים על בגד או בניין. בכל המקרים נדרשת תקופת הסגר והמניעה עד שהנגע יתחיל להתרפא לאחר מכן הוא חייב לכבס את בגדיו.
אם לפצע בתחילה יש מראה עמוק או הוא מתפשט בזמן הבדיקה אז האדם הנגוע חייב לעבור טיהור משוכלל. הוא חייב להביא שתי ציפורים כשרות. אחת מהן נשחטת כך שדמה זורם לתוך סיר מים שאליו עוברת הציפור השנייה יחד עם עוד כמה פריטים. המים הדמים מטפטפים על המצורע. שבוע לאחר מכן הוא חייב לגלח את כל השיער כולל ראשו מהגוף, להתרחץ, ולכבש את בגדיו. השלב האחרון הוא להקריב קרבן אשם וקרבן חטאת גם להביא כוס וחצי שמן. כמה דם של הקורבן החטא הוא לשים על האוזן, האגודל, ואת הבוהן של המצורע. עושה השמן כמו הדם וחלק ממנו הוא שפך על ראשו. אם צרעת מכה בגד הוא נשרף כולו או חלקו. בניין נהרס.
זו לא מחלה במובן המקובל, כי זה לא נזק ולא גורם לכאב. ברור שמשהו לא בסדר, למרות שהחומש אינו אומר זאת במפורש. על פי פרשנויות יש רמז בשם המחלה בלשון הקודש מְצֹרָע. הם אומרים שזה קצר עבור "מוציא רע". במילים אחרות המצורע עשה משהו רע וזה מופיע דרך פצע זה. הגמרא (מסכת ערכין טז ע"א) מפרט את שבע הסיבות שהם: הוצאת דיבה, שפיכת דם, שבועה לשווא, גסות, יהירות, שוד וקמצנות. אלה נוטים להיות עבירות שנעשות בחשאי. גם אדם יכול לעשות את הדברים האלה ואפילו לברוח עם זה למרות שאחרים יודעים על זה.
התורה מלמדת כי הרע כי אדם עושה יכול לצאת. אולי יש משהו מוזר בבית, בגדים, גוף, התנהגות, או משהו אחר. לפעמים הסיבה ברורה. פעמים אחרות ניתן להבין או לנחש. לפעמים לא יודע למה, אלא שמשהו לא בסדר. ייתכן שהגישה הטובה ביותר היא להתרחק מהמצב ולקוות שהרב יוכל למצוא פתרון בדרך שלו.
